One of the most important decisions for anyone seeking relationship advice is to tailor the process used to reach the agreement in order that it gives the right level of support and advice along the way.
Relationship advice processes
1: Sitting around a table with or without third parties
This can be sitting down together to discuss a settlement or seeing a mediator to help exchange all relevant information, explore options and consider the various outcomes. Equally if an elevated need for assistance is clear to reach solutions then meetings supported with solicitors is another good option. DIY, Mediation, Collaborative Law, or One Lawyer are all options available to you.
2: Constructive adjudication
Couples often need more help to discuss a settlement or agreement but still wish to resolve matters outside the court arena, especially if matters are complex or emotionally charged. An independent expert (often a part-time judge or experienced arbitrator or barrister) can be appointed to review a case and provide an indication of what the outcome might be if the matter proceeds to a court hearing. Alternatively, if you do not feel able to discuss matters directly with a former partner, then being able to negotiate safely, discretely and privately, supported by a solicitor could be key. Early neutral evaluation, private financial dispute resolution hearings, voluntary negotiations and round table meetings all fall into this category.
3: Contentious adjudication
We can always explore whether a resolution can be reached outside the court arena. However, where this is not possible, then the court process ensures that any dispute is resolved within a timetable and at the conclusion of the proceedings, you are guaranteed a binding decision. This could be done privately through arbitration or through the court system by issuing court proceedings.
